Looks like it’s that time of the year when Ericsson files a lawsuit against Samsung. This time the legal dispute is on grounds of contract violations.
According to reports from Ericsson, the lawsuit “addresses breaches of FRAND obligations by Samsung and seeks to obtain a ruling by the court that Ericsson has complied with its own commitments.”
Beginning with Q1 2021, every quarter Ericsson risks losing anywhere between $119.1 and $177.2 million. All this due to the current geopolitical conditions, delayed intellectual property royalty payments, and legal costs. With this lawsuit, Ericsson seeks to recover these expenses when the legal dispute concludes and contracts are agreed upon. Meanwhile, Ericsson’s shares have fallen by roughly 6%.
As per reports, the lawsuit was filed in the US District Court for the Eastern District of Texas. If the lawsuit goes through, Samsung will be forced to pay Ericsson over ~$200 million. But as of yet, Samsung hasn’t said anything about this matter.
However, this case doesn’t come as a surprise to us. Earlier in 2012, Ericsson had filed a similar case against Samsung over FRAND-related reasons. Two years later, Samsung was forced to pay $650 million to Ericsson.
